EC Claim Process

Hong Kong's Employees' Compensation Ordinance is strict on timing. Miss the 14-day Form 2 deadline and the case becomes far harder to defend. Here is the exact flow.

Statutory deadlines at a glance

Same day
Notify LSC & insurer
Within 7 days
Form 2 for fatal cases
Within 14 days
Form 2 / 2B to Labour Department
Within 21 days
Employer pays medical / compensation

End-to-end flow chart

Six steps from injury to settlement.

01
Immediate response

Provide first aid, send the worker to A&E if needed, secure the scene and notify LSC the same day via WhatsApp.

02
Form 2 / 2B to Labour Department

Submit Form 2 within 14 days for work-injury cases (Form 2B applies to minor injuries with incapacity of 3 days or less). Fatal cases require Form 2 within 7 days. We prepare and lodge it for you.

03
Medical & sick leave

Collect all sick leave certificates from a registered medical practitioner, treatment receipts and medical records throughout the recovery period.

04
Assessment — Form 5 & Form 7

Once the injury stabilises, the Employees' Compensation Assessment Board issues Form 5 (compensation assessment) and Form 7 (Certificate of Assessment) for sick-leave compensation.

05
Employer pays, insurer reimburses

Employer pays the worker within 21 days of the certificate, then claims reimbursement from the insurer for sick-leave pay, medical expenses and any permanent incapacity compensation.

06
Case closed

Final certificate of compensation issued. Keep records for at least 6 years for audit and renewal purposes.

Common questions

What if I miss the 14-day Form 2 deadline?+

The insurer may decline the claim and the Labour Department can fine the employer up to HK$50,000. Contact us immediately — late submission is still better than none.

Does EC cover injuries on the way to/from work?+

Only if the journey is part of duty (e.g. between job sites). Ordinary commuting is not covered under the Ordinance.

Who pays the worker's wages during sick leave?+

The employer pays sick-leave pay upfront, then the insurer reimburses 80% of monthly earnings under the EC policy.
